Terms and Conditions relating to the Safe Travel by Cigna Application

This application ("Safe Travel by Cigna") is owned and operated by our partner Healix International Risk Management Services Limited with a registered office at Healix House, Esher Green, Surrey, KT10 8AB "We", "Our" and "Us" refers to Cigna your international health insurance provider and to Healix International Risk Management Services Limited.
Data Protection
The Safe Travel by Cigna App allows you to upload some information for added security and to review security travel alerts published from time to time. Information uploaded to the Safe Travel by Cigna App will be held on the servers of Healix International Risk Management Services Limited, who are the data controller for such information under the Data Protection Act 1998. Any personal information you supply to Us when you use the Safe Travel by Cigna App will be used in accordance with the Healix International Risk Management Services Limited privacy policy which can be viewed at https://healix.com/privacy-and-cookies (and to the extent applicable the Cigna Privacy Policy which can be viewed at https://www.cignaglobal.com/privacy-statement).
Proprietary Rights and Licence
All trademarks, copyright, database rights and other intellectual property rights in the Safe Travel by Cigna App together with the underlying software code are owned by Us or by our licensors. We hereby grant you a non-exclusive, revocable licence to use the Safe Travel by Cigna App for your personal, non-commercial purposes. This licence is subject to you complying with these Terms and Conditions.
Conditions of Use
You will not and will not allow on your behalf third parties to (i) make and distribute copies of the Safe Travel by Cigna App; (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile or translate the Safe Travel by Cigna App; (iii) create derivative works of the Safe Travel by Cigna App; or (iv) use the Safe Travel by Cigna App in a manner that is likely to cause harm or offense to any person or that infringes intellectual property rights of any person.
Free Application; Right to Amend or Withdraw
The Safe Travel by Cigna App is currently made available to you free of charge for use on your phone whilst you remain a policy holder of the Cigna Global Platinum or Gold plan. We reserve the right to amend or withdraw the Safe Travel by Cigna App, or charge for the application or service provided to the phone, at any time and for any reason.
Limitation of Liability
In no event will We be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use of or access or uploading of your personal travel documents to the Safe Travel by Cigna App, including loss of profit or the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages, except that nothing in these Terms and Conditions shall exclude or limit Our liability for death or personal injury caused by negligence or for fraudulent misrepresentation. For avoidance of doubt, the content of the Application is for guidance only. It shouldn’t be relied upon solely when you are planning travel. We recommend you check with the Foreign and Commonwealth Office or equivalent government organisation for official travel updates or restrictions.
Disclaimer of Warranties
To the maximum extent permitted by law, We disclaim all implied warranties with regard to the Safe Travel by Cigna App. The Safe Travel by Cigna App is provided "as is" and "as available" without warranty of any kind.
Indemnification
You agree to indemnify, defend and hold Us harmless from any liability, loss, claim and expense (including reasonable legal fees) arising out of or in relation to your breach of these Terms and Conditions.
